I work for a large company who didn't buy Trump a gold statue. I have recently been assigned to 2 new projects. 1) Knowledge transfer to Bangalore 2) Knowledge transfer to Singapore. All US contractors were let go. Many but not all were Indian. I don't know their visa statuses. Our focus is to move the work ASAP. Singapore will pick up whatever Bangalore can't handle. Bangalore is the preferred site due to lower costs. It's already happening.

Now it's multiplied by 20x? It's going to kill any international labor.

This almost fixes our white collar issue in the US except that outsourced labor isn't actually the taxed part, imported labor is. Offshore labor isn’t any more expensive, but bringing that labor (and productivity) to the US is now massively more expensive.

So medical students from other countries often train here. They either get J1 or H1B visas, typically sponsored by their training program. Fewer programs sponsor H1B since it was more expensive and time consuming. J1 allows you to train, but you have to go back home, whereas H1B let's you stay here and work as a physician. I think there is a pathway that allows J1 residents to stay, but not sure how likely that is. I once knew a fellow who tried and failed to do that.


Hospitals (Medicare) who pay the residents $50-70K/yr aren't going to sponsor $100,000 residents, so we'll probably see more J1 than before. Meaning that a lot of residency spots are going to people who are just going to peace out after the fact. We're going to lose a lot of foreign and potential doctors. And while I can't find great statistics, the AMA estimates that 25% of doctors are foreign grads.


Here's the kicker. They have to be incredibly smart and motivated to take spots from American grads. And they work/train at places most Americans wouldn't want to train at. Not just inner city hospitals, but a lot of rural (Trump voting) places too. So I see this hitting healthcare for Red voters harder.


Edit: Apparently J1 visa holders have to go back to their country for two years before they can apply to stay. They can apply for waivers, but no idea how hard that is. I think one way is to already have a job offer to work in a designated underserved area in an underserved medical field, though I feel like it would be hard to get that done fast enough.

The h1b system was not being used as intended; Eg: To get workers for jobs americans didn't have the skills to do. Instead it was a way to get cheaper labor.

Also the incoming workers' visa was tied to their employer: no job, no visa. In other words if you're laid off you're also deported. I witnessed a lot of H1B's working far more hours than they should have because if they didn't, it was back to India for them.

Too late to matter.  An entire decade of American I.T. graduates got screwed out of a career.   Chase bank in Ohio has so many their department doesn"t even speak English anymore. With the added $100K / person, companies will use that as a justification to accelerate more office centers being created in India, which has been happening for years anyway.  More capitals will be allocated to those.  So most of these jobs will still be done in India.

I don't necessarily think these will create a lot of new jobs in the U.S, especially in the engineering space that is lower / junior.  however, temporarily, this will probably boost demand for mid-level talent.

Is the H1B program abused? Big time. Companies use them to depress Tech salaries, pretending there is a shortage when there is not. They just don't want to pay American PhDs what they are worth. 100k for an H-1B basically means small companies are out. Startups just won’t bother, they’ll hire remote in Canada or India. Big Tech can pay but they’ll just spin up more teams in Toronto, Dublin, Singapore, etc.

It’s really unclear yet how big of an impact this will have. There is conflicting information on whether this will affect the F1 to H-1B pipeline. If that is left as is, this is largely going to do affect nothing. If it does, it will be a significant change for a small group of people. 

It will mainly be beneficial for new graduates in tech just joining the work force next year as they won’t have to compete with H1-B applicants. Yes some jobs will move oversees, but there’s a reason everyone returned to work, a lot of people believe working in office is more effective. However it’s important to understand that the effect will be limited to the more junior level job market as existing H-1Bs have been confirmed to not be affected by the changes.

I’m an immigration attorney who works with a lot of people who are on H-1B status. This 100,000 fee is a terrible idea. That being said, the H-1B visa is in need of reform. 

Calling it “slave labor” is incredibly hyperbolic but there is quite a bit of truth to the fact that employees on H-1B can be exploited based on their immigration status and be forced to work longer hours and endure abuse a regular employee wouldn’t. Plus there is the consultancy company culture and there is some fraud around that with H-1B holders not being paid what is officially being offered.

It’s a reasonable idea to curb abuse of the H1B system, but in typical Trumpian fashion it’s being done in a capricious and openly corrupt way, as opposed to a principled, rules-based way that companies can follow. 

For example the recent scramble of employees was absolutely pointless and caused weeks of lost productivity. They could have implemented it as a policy beginning in 2027 with clear rules and regulations for companies to plan for, but again, Trump.

The negative feelings around the program indicate that it does need reform and you will find a lot more negative anecdotes than positive ones across Reddit about it, but this Trump policy?

* It is bad because Trump's policy asserts he can waive the fee for whoever he wants, like if an FBI agent working for Amazon hands him a bag of $50,000, so it creates an uneven playing field that potentially benefits only large corporations or Trump's perceived allies. So the "pros" that many people are excited about might not manifest how they are thinking.
* It is a near-meaningless because sophisticated companies can already bring offshore talent into the US after one year working remote with L-1 visas.
* It is short-sighted because visa holders have been critical to founding and building many of the big companies people are now saying should hire exclusively Americans, immigrants have grown the sector for all of us and the US has the highest salaries in the world partially because of that. My belief in that fact is why I am on this sub.

However outside of a few tech giants, the largest users of these visas are consulting companies who have allegedly used the program to bring employees in from overseas and offer them as lower cost on-site consultants which have replaced local workers in ways that have been very publicly reported on over the years at the types of companies many Americans cherish, [like Disney](https://www.nytimes.com/2015/06/04/us/last-task-after-layoff-at-disney-train-foreign-replacements.html). I think this where the majority of the disdain for the program comes from, the visas also overwhelming go to Indian applicants, inflaming a range of negative stereotypes that you can easily find across this site.

Cons (and honestly like all of reddit) like this policy because they believe H-1B workers are undermining their own employment opportunities in sectors where they perceive no labor shortage, and they believe H1Bs are bringing down wages (it is extremely difficult for H1Bs to switch jobs, so they cannot really negotiate with their sponsoring employer). This belief is exacerbated by the current hiring climate where sectors like tech have seen significant layoffs and reduced hiring among workers who have gotten used to being highly in demand and competed over.

The issue with H1B visas is that there are a limited amount. If you have no criminal record, and an employer willing to hire you, you should be allowed to immigrate and work that job. There shouldn’t be arbitrary restrictions.

Sigh. I’m a neolib but as someone who works in tech in the Bay Area, the whole H1B situation is sus. I’ve worked with lots of legit H1B people that are very great. I’ve also worked with way too many H1B workers who just won the H1B lottery but were absolutely terrible at their job. One example was a dude 1 year out of school who won the H1B lottery who absolutely sucked at their job. Like why are we hiring new grads on H1B when unemployment is so high for new grads.

I’ve also worked at a FAANG company known to abuse H1B. Legit in my org of 100 people two of us where white and literally the other 98 were H1B from India. Good dudes but when 98% of the org is on a visa from India you know something is up. I quit after 1 year because my co workers would literally all speak Hindi even when I was around. Pretty sure they did not want me there at all. I made one friend on that team who explained to me everyone in the org was in the same caste, which was also super fucked

The H1B system had a lot of issues, the Trump admin was (surprisingly) fixing it, and then they did the most hair brained move possible.

First, I think it's right to acknowledge that H1B system had issues. Lottery rates were down to 10% because of exploitive practices by a lot of tech companies. It didn't matter if you were a wage slave at a WITCH or a new professor at a university, it was 10% across the board. The whole thing was broken and was not serving it's intended purpose.

But to the Trump admin's credit, they actually did a lot to reform the H1B system before this 100k fee. Between stopping the mass filers from abusively filing multiple apps for the same individuals and the new proposed rule that prioritize higher earners, we were on track to a functional H1B lottery.

Unfortunately, like basically anything out of the Trump admin, there is no overall strategy and policy decisions are made on a whim and sometimes in completely self-defeating ways. There was no need for this 100k fee (which is actually legally implemented as a stupid donation/bribe/direct payment to the Treasury and not a "fee" charged by USCIS). The wage based lottery was going to sort out the rates. But instead, we get a fee that will kill sponsorship or lead to stay-or-pay arrangements that will further slowdown labor mobility in H1B holders.

Oh and to add on top, this admin implemented this 100k fee without giving any guidance ahead of time. Instead of publishing a long piece of guidance subject to notice and comment, this admin just signed a hair brained order and no one knew what was happening for the first 24hours. And we still don't have clarity on whether individuals who are applying for h1b via a change of status will be subject to this fee. Let's not even get into the fact that this whole thing was done in complete ignorance of the administrative procedures act. We're going to be bogged down in a completely unnecessary APA legal challenge that will leave the entire system in regulatory uncertainty for the next year.

H1b is kind of a pain already.  We have 1 (had 3).  We paid them market rate.  2 were great and one sucked.  We won’t pay the $100k, but our larger competitors might, so in the end it’ll help them and not us.  Give them the competitive advantage.  Some of these h1-b folks are really great.  It is a pain, though, and the extra fees (even before the massive increase) do hit the bottom line.

I do want to ask, specifically for tech at least, we have seen hundreds of thousands of tech employees laid off over the past few years (granted these haven't all been software engineers, but its still a staggering amount of layoffs). To me that implies there is more than enough domestic tech talent for the number of jobs that are available (there has been almost no growth in the tech industry in the past couple years iirc), so if that is the case, why are tech companies so motivated to hire employees on H1B visas? We can talk about the macroeconomic benefits of immigration all day, but the tech industry has not been growing over the past few years even with the continued intake of H1B visa holders while many domestic tech workers can't find jobs. I just kinda don't really understand it unless its because they specifically want to hire visa holders for a reason beyond talent (some reasons I've seen proposed online include being able to hold them hostage since they can't easily move between companies so they can work them harder, to undercut wages, Indian managers intentionally only hiring other Indians, etc).

Of course this “reform” is flawed. The H1B visa isn’t easy to get. I would know as I had one to get into the US. It took months because you had to prove - or rather those hiring you - had to prove that you had a unique set of skills not available in the US. It is only valid for a limited time and can only be renewed for a limited time. The reason why it exists is because the US ranks 31st in education and has a shortage of highly skilled workers in very specific roles - especially in healthcare, tech &amp; engineering, and even finance and certain skills trades and manufacturing. Healthcare will suffer because nurses are already underpaid and won’t pay $100k to bring someone in. Tech jobs will simply be remote so money leaving the US instead of staying in the US. But then, this administration has not been good for the economy - housing market is contracting, inflation is way up etc.

If you buy the logic that this is meant to protect American jobs (which I don’t, more on that in a moment), the flaw is that you can only hire Americans to do these jobs if you have Americans qualified to do them, which we don’t. Our workforce is, frankly, stupid. You have a mass of relatively low-skill, undereducated people who have little interest in learning anything at all. And on top of that, the education system is being gutted to the point that we couldn’t produce educated workers en masse even if we wanted to.

My conspiracy theory is that this is being pushed by AI CEO’s to make it harder for American companies to hire qualified humans and force them to increase their reliance on emerging AI technologies.

I think it shows we need reform in regards to our work visas. we need to shift workers from tech and into other industries that require high skilled workers like nursing. we have too many tech workers out of work and skilled kids unemployed coming out of college with tech degrees. this should reduce the tech visas and open up other areas that have need for them. we need the ability to shift as demand is required and not bend the knee to lobbyists of tech industrie. I think the fee is excessive but not in regards to over saturated areas like tech.

This reform is great. It ensures H-1B is used to attract top talent by employers willing to make an investment in the best and brightest. It’s not the best for body shop consultancies who undercut American labor, which is fine with me.

Prioritizing higher salaries should be enough. The additional $100k is a bit much and unnecessary. As a US-born techie, I will benefit from these changes. But I also want to be part of the winning team. We should drop the $100k fee to steal the world’s brightest to help us keep winning.

I think it’s important not to have a centralized high tech industry. The extent this helps India and China build their industries it is good for the world. This will help nations retain their best and brightest. It will be bad for the US but what is bad for the US seems to be good for the world.

Doesn't matter. A lot of the the most important jobs can be performed remotely (knowledge based) so off shoring and near shoring will surge.

Bad idea in general in my opinion as it can compromise long term development for short term gains. The US has long been a hub for some of the brightest minds in the world. Other countries might take advantage of this.

The reform is chaotic and will have overall negative consequences in the longterm (even if it is found illegal). It will hurt smaller startups and universities. Without having the upfront capital, American research hegemony and job creation in tech sector will suffer. As for prioritizing higher salaries, this could backfire on the adminstration. There will be loopholes found by these WITCH companies that allow them to garner a greater share of the talent pool than before.

A few thoughts.
1. It would be better to raise the minimum wage for H1B by industry.
2. Current 100k fee is basically a tax that creates big govt spending and doesn't benefit either the employer or the employee.
3. Since this is a flat fee not categorized by industry, it is biased for big tech who can still afford to pay but will disadvantage smaller startups, academia and non-tech industry.
4. Such a prohibitive fee on new work visas essentially spells the end of legal immigration. This exposes the old tired defense from republicans that they are only against illegal immigration. Truth is that it was always about race and culture. There will be many excuses, but the hidden goal is clear.
